By accessing or using Octolix ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

Octolix provides AI-powered assistant hosting services that integrate with messaging platforms including WhatsApp, Telegram, Discord, and others. The Service is provided "as is" and "as available" without warranties of any kind.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information and promptly update any changes. You must be at least 18 years old to use this Service.

4. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Infringe intellectual property rights of others
• Transmit harmful, threatening, abusive, or harassing content
• Distribute malware, spam, or phishing attempts
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt unauthorized access to any systems
• Use the Service for any illegal or unauthorized purpose
• Generate content that violates third-party platform terms (WhatsApp, Telegram, etc.)
• Engage in automated mass messaging or spam

5. AI-Generated Content Disclaimer

IMPORTANT: The AI assistants hosted through our Service generate content automatically. We do NOT guarantee the accuracy, completeness, reliability, or appropriateness of AI-generated content. You acknowledge that:

• AI responses may contain errors, inaccuracies, or inappropriate content
• AI-generated content should not be relied upon for medical, legal, financial, or other professional advice
• You are solely responsible for reviewing and verifying AI-generated content before acting upon it
• We are not liable for any decisions or actions taken based on AI-generated content

6. Third-Party Services

The Service integrates with third-party platforms (WhatsApp, Telegram, Discord, etc.). Your use of these platforms is subject to their respective terms of service. We are not responsible for the availability, content, or practices of third-party services. You are solely responsible for compliance with third-party platform terms.

7. Payment and Billing

Paid plans are billed in advance on a monthly basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice. Failure to pay may result in service suspension or termination.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
• WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS
• WE ARE NOT LIABLE FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• WE ARE NOT LIABLE FOR SERVICE INTERRUPTIONS, DELAYS, OR FAILURES

9. Indemnification

You agree to indemnify, defend, and hold harmless Octolix, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of third parties.

10. Termination

We may suspend or terminate your access at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and Octolix regarding the Service and supersede all prior agreements.
